This is the actual video that was shown in court in front of the judge, Mia's friends and family, and the convicted murderer, Jesus Mesquia. The murderer was sentenced to more than 36 years in prison for the rape and murder of rising punk singer Mia Zapata back on July 07,1993.

I was a big fan of The Gits, I still am. To me Mia was the Janis Joplin of her time. The band was growing and their sound was getting tighter. Her death was heartbreaking to me. Senseless and terrible, murdered by a low life piece of $hit. He should have gotten much more time in prison for the pain he put her through.

I don't expect the people on this site to embrace her liked I do, but to me she was one of the greats. I miss her. It breaks my heart to see her Dad hurt so much

KENT, Wash. – The man convicted of raping and murdering up-and-coming Seattle rock singer Mia Zapata may be getting out of prison early.

A U.S. Supreme Court decision overturned the killer's sentence, but King County prosecutors are headed to trial to make sure he serves all of his time.

Mia Zapata has drawn a cult-like following since her death in 1993. Several movies and documentaries have been made about her career as the lead singer of the Seattle-based band "The Gits" and about her brutal murder.

The killer had repeatedly bitten her. She was raped, and strangled to death with the strings of her own sweatshirt.

The case was a mystery for 10 years. Then DNA technology caught up to a man named Jesus Mesquia, a fisherman living in Miami.

He was convicted of the crime and sentenced by the judge to 36 years in prison – 10 years longer than the standard range because of the excessive cruelty.

Three years after being convicted of murdering Zapata, the U.S. Supreme Court ruled only juries, not judges, can hand out exceptional sentences. That means Mesquia is headed back to trial for a new sentencing.

A new jury will be seated to hear the gruesome details of what happened to Mia Zapata-to answer the question: Was it excessively cruel?

"The manner in which he took great delight in inflicting pain and suffering on her before she died, that by anyone's definition is deliberate cruelty," said Steve Fogg, Special Prosecution.

Tuesday, Mesquia was back in court getting ready for the trial. Prosecutors are determined to keep the lengthy sentence as is.

"When someone's not just murdered, but murdered in an extremely painful and inhumane way, there is an extra price to be paid for that," he said.

In a strange twist in the hearing, Mesquia told the judge he doesn't want to get out of prison early, that the exceptional sentence is fine with him. His lawyers said they don't know why he feels that way, but they'll be exploring that in the weeks to come.

A trial date has not yet been set. Defense attorneys told KING 5 they will fight to get Mesquia out early, saying 26 years is long enough for his crime.

These 2 statements taken together anger me. This creature does not deserve an early release after the obscenely vicious manner in which he tortured, raped, then murdered Mia Zapata.

Did you ever see her band live ?

Was she as well thought of as it seems she was from listening to others ?

Do you like I ,see her as a modern day Janis Joplin..at least in a way.

Kenny, not knowing a lot about Mia, except for the education I got from this thread, she didn't seem like she was as self destructive as Janis.And I don't mean that as a slam to Janis, but she loved a buzz, and hers got away from her. Mia seemed to have her poop grouped by all accounts. She was on her way when that creep took her life. IF he does get out, I hope he gets a little street justice. Only seems fitting.

You may be right, I know she did like to drink, but have never really read about her being a big drug and alcohol abuser.

I guess one thing that makes me think about Janis, is Mia could be pretty when she wanted to. But a lot of times she sort of went about with a sort of non caring look. I know Janis was that way also. I never thought Janis was ugly or Mia. I have seen pictures of Janis when she really looked nice. I guess it's because they both died to young and tragic, even though Janis was self inflicted.

Some more info :

On the morning of July 7, 1993, around 1:00 a.m., Zapata left the Comet Tavern bar in the Capitol Hill area of Seattle. She went down the street to the apartment of a friend. She left around 2:00 a.m., telling her she was going home. This was the last she was seen alive. She may have walked a few blocks West to get a cab, North to a friends apartment, or decided to walk home.

She was brutally raped and murdered in the Central District. It is believed she encountered her murderer shortly after 2:15 am. Since the barkeep remembered her wearing her headset as she left, it is believed she was listening to music from her walkman and thus was unaware of the approaching danger.

According to Unsolved Mysteries, a man two blocks from the Comet Tavern heard a scream around 3 am. A woman found her body in the street at around 3:30 am near the intersection of 24th and Yesler in the Central District neighborhood. Her body was in a Christ-like position (arms stretched out, perpendicular to her body) which gave rise to the belief that it was cult killing. According to the medical examiner, if she had not been strangled she would have died from the internal injuries suffered from the beating.

Legacy

In the aftermath of her murder, friends created a self-defense group called Home Alive, which exists to this day. Home Alive has organized benefit concerts and CDs with the participation of many of Seattle's music elite, such as Nirvana (one of lead singer Kurt Cobain's final public appearances), Pearl Jam, Heart, and the Presidents of the United States of America. Joan Jett also recorded an album with the surviving members of The Gits called Evil Stig ("Gits Live" backwards). The Home Alive group has its own instructors. They hold a range of courses, from anger management and use of pepper spray to the martial arts.

Portland, Oregon-based alternative rock band Everclear dedicated their 1993 album World of Noise to Zapata.

Punk rock band 7 Year Bitch, who were good friends and briefly label mates of The Gits, named their 1994 album ˇViva Zapata! in tribute to Mia Zapata. The album cover also featured a painting by artist Scott Musgrove featuring Zapata wearing bullet sashes (bandoliers). The song "M.I.A.," which explicitly deals with Zapata's death, appears on this album.

Zapata was also one of the featured artists in the 1996 grunge documentary movie Hype!.

In 2005, a documentary The Gits Movie was produced on her life, The Gits and the Seattle music scene. Its first showing occurred at the Seattle International Film Festival in May of that year. Another version of the film appeared two years later at the 2007 SXSW (South By Southwest) Film Festival, and the final cut of the film was released theatrically in over 20 North American cities on July 7, 2008, the 15th memorial anniversary of Zapata's death. The following day saw the film released on DVD along with a Best of the Gits CD (both from Liberation Entertainment).

I saw the Gits once, they rocked. Mia was loved by all of the local musicians. I didn't know her personally but know some of her friends. I used to hang out at the Comet Tavern on Capitol Hill which is where she had left from the night she was murdered. She definately had the Joplin pipes and was on her way to the bigtime....very tragic. I hope he gets what he deserves for what he did to her...that scumbag.
