Critics, including at least two lords, say that legislation coming into force next month forbidding the possession of "an extreme pornographic image" will criminalise thousands of previously law-abiding people who have a harmless taste for unconventional sex.

Section 63 of the Criminal Justice and Immigration Act 2008 comes into force on 26 January and makes owning offending pictures a criminal offence punishable by up to three years' imprisonment. An image is deemed to be extreme if it "is grossly offensive, disgusting or otherwise of an obscene character" and portrays in any way an act which threatens a person's life, or which results or appears likely to result in serious injury to someone's genitals or breasts.

Remarks: How is this even a debatable issue?

Snuff films are not illegal (at least in the US), and according to the Wiki page I found, no U.S. law enforcement agency has put forth legislation or terminology that would define the term "snuff film" authoritatively. Of course the maker of a snuff film is commiting an illegal act in creating it, but legality of such a film itself is a gray area at best. In any case, this law, as I read what is posted here, is not limited to "snuff" films/photos, it includes photos that portray "an act which threatens a person's life" which is way too broad, IMO.

For example, it would seem that this famous photo which appeared on the front page of the NY Times in 1968 and became a symbol for everything that was going wrong in the Vietnam War would be illegal under this law (here's a link, I won't post the actual photo because it is rather distrubing):

I knew which photo it was before I even looked! Personally I find porn disgusting from concept to execution but it's not my place to draw the line as long as kids aren't involved and no one dies in the making....then it's a legal issue. Unfortunately, or fortunately, depending on one's point of view....that's what the first amendment is about.

Right now theres a case in Iowa that has a man facing charges for his Anime collection being considered "child porn" because of the scantily clad comics being considered contraband.

1. Depicting a minor engaging in sexually explicit conduct; OR

2. Depicting an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex;


Child Pornography which consists of graphic crime scene photos and movies, showing the rape, torture and abuse of young children is not acceptable under any Amendment...

Each state has its own definition of what constitutes child porn. Pictures of naked children will get you 10 years in Texas. Part of the issue in the Iowa case is how Anime is depicted. The Japanese do not care for body hair so pubic hair is typically not drawn on explicit comics, thus giving the subjects a child like appearance. Is this considered child porn? I dont think so.

Yes so the comics are drawn to suit the Japanese taboos against oh lord...EVIL PUBIC HAIR! We as a nation need to make child porn as much of a societal taboo and start treating it as such... they can demand a change in the depiction of these comics to suit their tastes then so can we.

I've seen Manga movies, the most famous one being Ghost In The Shell. The most offensive thing about that movie is the fact that it seems to last about 462 hours. Just movies with plotlines and such, just animated. I don't remember any sexual scenes in the ones I saw. Perhaps the comics are different. ST does make a valid point - the Japanese look at things differently in their culture.

It would be hard to define Manga characters as being at any age.

What? Anime and Manga are Japanese in origin so therefore would commonly reflect their cultural mores. They arent demanding anything, they are simply creating what they create. We seem to be the ones with an issue about it all.
