SPRINGFIELD, Ohio -- A Tri-State woman is in critical condition Wednesday after police say her husband shot her while they were having sex.

Timothy Havens, 38, told Springfield police he was reaching for something on the nightstand when the pistol went off, hitting his estranged wife Carolyn in the upper chest. (Hear part of the 911 call)

Carolyn Havens, 42, is being treated at Miami Valley Hospital in Dayton.

This is isn't the first time there's been trouble for the Havens. Court documents showed Timothy served 60 days in jail for assaulting his wife and was ordered to go to anger management classes.

His arrest Tuesday for the weekend shooting was for violating a civil protection order that Carolyn had taken out against him earlier this year.

Bond was set at $75,000 after prosecutors asked for a high bond, "due to alleged prohibited contact between the parties (and) the suspicious nature of the circumstances surrounding (her injury)."

His estranged wife who he has abused in the past. When I read this I thought, gee, I can't wait to hear her side of the story. Although there actually are women who thrive on abuse, believe it or not. I suppose maybe she never thought he'd take it this far.

I don't mean any disrespect to the victim, of course. I hope she recovers to tell her side of the story.

The woman is in critical condition. I think the jokes made about the shooting are funny but speculation about whether or not the woman enjoyed being shot and is planning to profit off of it don't sit very well with me for some reason.

(12-03) 16:26 PST SAN FRANCISCO -- A state appeals court said Wednesday it was right to overrule Gov. Arnold Schwarzenegger last year and order the release of a San Mateo man who beat his wife to death with a hammer in 1986 after she taunted him for refusing to have sex.

Peter George Cooper was freed on parole in August 2007 after the First District Court of Appeal found that Schwarzenegger had provided no evidence for his conclusion that Cooper was still dangerous. The state Supreme Court rejected Schwarzenegger's request to block his release, but put the case on hold while it considered the extent of the governor's power to overturn parole board decisions.

The high court then ruled in August that a crime committed many years ago does not justify confining a prisoner who is eligible for parole and is no longer a threat to the public.

When the case returned to the appeals court, lawyers for the governor argued that the brutality of the crime and Cooper's statements in past parole hearings showed he was still dangerous. The three-judge panel disagreed Wednesday and said Schwarzenegger had presented no evidence to contradict the Board of Parole Hearings' February 2006 conclusion that Cooper was suitable for release.

Cooper was a computer programmer and consultant who became an alcoholic in the early 1980s and suffered a seizure in July 1986 while trying to quit drinking. The court said he and his wife, Joan Harwit, were embracing in their home one day in November 1986 when he asked her to stop and she became angry, questioned his manhood and yelled at him for about 10 minutes.

Cooper hit her in the head with a sledgehammer, hid her body in the trunk of her car and told police she was missing, but confessed four days later. He was convicted of second-degree murder and sentenced to 16 years to life in prison.

The parole board approved Cooper's release in 2006, citing his participation in work programs and therapy, remorse for his crime and favorable psychiatric evaluations. Schwarzenegger, exercising his authority under state law, then blocked Cooper's parole, saying the "especially heinous" nature of the crime showed he was still dangerous.

The appeals court said Cooper's crime was comparable to most other second-degree murders and was not enough to show he is a threat to public safety.

That was in response to the Jerry Springer reference. Of course I could be wrong....maybe she was asking for it. I just always thought getting shot would be a real turn off during sex. I could be wrong.

When I was an H.R Mgr, I interviewed this man who had just gotten fired from his previous job. I asked him what for.

He said "This guy yelled at me and I hiit him on the head with a hammer".

Needless to say he did not get a call from me later.

I was told to fire this one Dude. He told me "Kenny, I like you man, but i'm going to have to off you.". Then he left.

So later he pulled up in the parking lot and I went out to talk to him. He had this big ass pistol in the seat next to him.

He looked at me and said "Don't worry about the gun, your actually the only one here that ever treated me right". Then he drove off again.

Months later he called and ask me to rehire him.

We had a secretary killed in the office by her ex husband during the 90's. He shot her right down the hall from my office. The Dude ran out as I was running to her office. She died in my Supervisors arms..right in front of us. She was so sweet, it broke my heart. Her piece of sh*t husband is rotting in prison.

No wonder i'm a f*cking mental case. 12 years as a H.R. Mgr in a crime filled city was enough to do it. Years later I walked away from that postion and gave up the most money I had ever made yearly in my life.
