Paris Hilton is headed back to jail. She was taken from court screaming and crying after Judge Michael T. Sauer ordered her to return to jail to serve the remainder of her entire 45-day sentence on Friday.

"It's not right!" Hilton, 26, shouted as deputies approached her in the courtroom. She also called out to her mother in the audience: "Mom!" Kathy Hilton, accompanied by Paris's father Rick, answered: "Honey!"

Before the hearing began, Hilton entered the courtroom at 11:00 a.m. wearing a gray sweater, gray pinstripe slacks and looking disheveled. FOX News reports she was weeping and turned to her parents seated behind her in the courtroom and mouthed, "I love you."

The judge's decision came after hearing arguments from both the L.A. City Attorney and Hilton's lawyers. Judge Sauer ruled that because the sheriff's department had not adequately submitted medical records supporting why Hilton was released, she should be returned to jail.

Court spokesman Alan Parachini said after the hearing that Judge Sauer hadn't bought the sheriff's "medical condition" rationale for sending Hilton home. "What he said was, on the record, that he'd seen no evidence, no documents to support the contention that there was a medical condition." Details of Hilton's alleged condition were not released in court.

Earlier in the day, a sheriff's car picked Hilton up at her home and took her to court for the hearing.

As a swarm of media watched, Hilton parted ways with her parents, and her mother told reporters: "It is what it is and it's in God's hands now."

She added: "It's out of our hands. There's nothing we can do."

Asked how her daughter is faring, Kathy said earlier, "She's doing the best she can."

Paris Hilton was seen being handcuffed before getting into a police cruiser and was photographed crying in the backseat.

As the gates of the driveway opened, the scene was pandemonium, with the officers on their bullhorns and Hilton's fans screaming.

Friday's proceeding was granted by Judge Sauer after the Los Angeles City Attorney requested an emergency hearing to demand that the Sheriff's Department put Hilton back in jail.

City Attorney Rocky Delgadillo had accused the department of disobeying the judge's original sentencing orders, which explicitly forbade electronic monitoring.

Yet due to an undisclosed medical condition, Hilton was released from Century Regional Detention Facility in Lynwood, Calif., early Thursday and reassigned to home detention after serving just three days of her minimum 23-day sentence.

The heiress was fitted with an ankle bracelet and her original 45-day sentence was reinstated since she'd enjoy the confines of her Hollywood Hills home instead of a 12-by-8-foot cell with credit for five days served.

Hilton's reassignment sparked outrage across the nation; the L.A. Board of Supervisors alone received more than 500 angry calls, e-mails and faxes by Thursday afternoon. At least two of the supervisors demanded an investigation.

Sheriff Lee Baca, who ultimately approved Hilton's transfer, defended his decision, telling the Los Angeles Times that "the minute I was informed by the doctors about her medical condition, I realized the system was not able to respond effectively to these problems."

He added that her three-day incarceration was more than what most people guilty of violating probation would receive.

"We did what is best and what is justice," Baca added.

Someone needs to explain to me why these rich Hollywood types can go out and pay $500 for a bottle of booze but they can't shell out a couple of bucks for a limo driver. There's no excuse for these spoiled morons to be drunk behind the wheel.

the public spectacle of this whole thing is sickening.

i never thought i'd say this but i feel real bad for this girl. shes suffering pretty badly, and i dont wish that on anyone. to have your worst moments captured on film like that, and to have the public devour it like hungry wolves is just disturbing.

But you see, that is what this non-talented girl is famous for. Pulling a prank, acting dumb, and getting publicity for it.
Think of this as a publicity stunt for her next "Real Life" season.

Plus, next time she's told not to drive without a license, she'll listen.

Agreed Linnie, its a sign of the times unfortunately. If the media would take as much effort to cover serious stories like they do with things like this, who knows how much more we might know about what goes on in this country. Way to go American media.

Well, I find this whole thing hysterical....

This girl doesnt have a clue about real life. She has been spoiled her whole life and never had to answer for her actions. Now she does and this is how it goes.

The Sheriff is dispicable and a joke. I hope the judge holds him in contempt and he can have the cell next to Paris. The Sheriff, while a very powerful position, does not entitle him to violate a judges orders. I got to love the medical excuse though.... like there arent hundreds of sicker, truly sicker people, in his custody right now that dont have a hope of getting home supervision because they arent rich and crying at the top of their lungs. For Paris, this is the first day she has had to be accountable in her whole life. She has 44 more to go.

This person has over exposed herself and her life for a long time now and she gets paid mega bucks to appear at those parties she attends. I fear she's gotten an unrnealistic idea of what it takes to be a dimensional human being. She wants the 'Simple Life'? She's got it now. I figure next thing you know we're going to see a rush of impressionable young girls rushing out to get the prison uniform starting a new fashion trend!

This is why I don't feel too sorry for her...even though she had a reprieve for awhile she still treated it as a publicity op. (I do agree that it's disguisting the amount of press that get's devoted to these spoiled little girls. Maybe if there wasn't a public interest, these girls wouldn't be so anal in their attempts to garner publicity through spoiled brat behaviour.)

While Hilton rested inside, about 40 photographers, TV crews and reporters gathered across the street in hopes of catching a glimpse of the heiress. Three helicopters hovered above and police officers patrolled the perimeter.

And the attention wasn't lost on Hilton.

At about 4 p.m., a male assistant with a video camera came out of the house to film the frenzy, asking the crowd if they loved Paris. He told the media that Hilton herself had requested the footage, noting that she wanted to see what was happening outside her home. Asked if she would make an appearance, the assistant said she "may come out."

While Hilton napped, goodies arrived. Earlier in the day, a representative of Mrs. Beasley's delivered three dozen cupcakes. "These are the flavors that she orders from us: strawberry and mocha. A dozen of each and a dozen assorted," said Anthony Crisafulli, a manager for one of the retail stores. "She's a customer of ours. She comes to our Beverly Hills store, and we decided it would be nice since she's had so much problems the last couple of days."

Around noon, a large fruit basket from Edible Arrangements that included chocolate-covered strawberries, grapes and melons was delivered, along with six cases of Party Animal organic gourmet dog food.

And later in the afternoon, two assistants carried in nine plastic grocery bags of food including cereal, Nature's Own breakfast bars, ice cream and frozen pizza.

As the deliveries poured in, Hilton's parents along with her lawyer made their exit. When reporters shouted "Congratulations!" to her parents, Kathy Hilton responded, "Thank you."

I pretty much agree here. But she entered jail to do 23 days and now has to do 45 because of the power struggle between the judge and the sheriff.That isn't right.

But she taunted authority and deserves to be in jail

In a way it is excessive, but the turning point was when she said that she would come to the court today "by phone." That is when it went over the dge. If her and her lawyers and family played it straight, none of this would happen. But she came a half late to court the first time around with her entourage, went against her probation and court orders, and kept pushing the buttons.

I understand what you are saying, but this woman has made her life into a public spectacle. She issues press releases as to what club she will be at on any given night. She constantly stops to be photographed. I crossed paths with her one night where she had such a large entourage, you coudn't help but notice her. She would stop so that any photographers could get a good shot. Now she is seeing the downside to her desire to be in the gossip pages. Now we will see if she learns anything from this.



the thing is that its not Paris that is at fault here (to a certain extent, i dont dispute that what she did was wrong and she needs to be punished) It is the the public consumption of whatever goods she's selling. just by virture of the fact we are discussing this little girls issues means that we are part of the problem, not the solution.

to say that "oh she wants the publicity and now it turned against her" is fine and well, but the world PUBLIClicity means the PUBLIC wants it.

and trust me, i am NOT a fan of Paris freaking Hilton. the little bitch used to have us shut down an entire floor of the hilton in cherry hill when she would come, at the last minute because her grandaddy is Barron Hilton.

I have to agree with Linnie on this. I'm no fan of the bimbo, but 45 days in jail seems a little excessive, and the way everyone is gloating over her problem (across the country, not just here) is kind of mean. Why hate her because she is rich and famous?

But the judge sentenced her to jail, and the sheriff was wrong to let her out. I think he was looking for some publicity for himself, and he should get it. A cell in his own jail.

In the end, this could be a very good thing for her. She really doesn't seem to have a clue, and time in the slammer is an eye-opener, for sure.

Not quite...the 23 days was with good time figured in. The original sentence was 45 days if I recall correctly. Now, that these events have transpired, the judge can waive the good time benefit she would have received. This really has nothing to do with a power struggle as by law, there isnt one. The Judge statutorily overrules the Sheriff each and every time with regard to court/judges orders.
