I thought for a minute we were dead in the water since most citizen arrest laws call for a felony to be committed......then I checked Georgia law and here is what I found in an article written by a Georgia attorney......I think we may be on to something:

5. Can Someone Other Than A Police Officer Arrest Me?

Answer:

Any person, such as a private security guard, can make a citizen's arrest if they see a misdemeanor being attempted or committed. (A misdemeanor is a criminal offense, usually punishable with a fine or short jail term.) They also can make a legal arrest for a felony as long as it actually was committed and they have good reason to believe you did it. They must take you to a police officer or judge who is required by law to take you into custody.

You may be on to something.

It would seem that the authorities would have to act.

Hope So

It might get even better if this holds true in Georgia:

Despite the title, the arresting person does not usually have to be a citizen of the country where he/she is acting, as they are usually designated as any person with arrest powers. In the USA, when performing a citizen's arrest it is advisable not to give a Miranda Warning or caution as this could be construed as impersonating a police officer; instead the arrestor should try to remember and tell the police officers anything the detained person has said.

If what I've read in other articles holds true in Georgia, just about anyone who sees the transgression could make the arrest. I suggest we delve into this further and get more information. It's only going to take a few times of this happening to make the point. And Candace and Buford always take photos before confronting the people who have gone over the rope.....instant proof.

Perhaps this may be some help.

Many houses up for sale have a small envelope box wiht a description of the house for sale.

My thought is to have one of these envelope boxes at the gravesight with some info sheets about Duane, Berry and some information about some of the past problems with vandalism at Rose Hill and the costs that have occured do to muddy feet, theft, chipping away at the marble, tombstone rubbings , burns and even stains left by flowers which were innocently thrown onto the marble and that the colors had blead out and migrated into the stone.
A note from family respectfully asking that visitors to not cross the baracade, that we understand the appreciation for Berry and Duane but please do not cross. Thousands of admireres of Duane and Berry have been here and gave showed their honor and respect without crossing the barricade, but it only took a few to create this situation and cause the damage.

The words written on Duane's grave would be a nice addition to the fact sheet.

Unfortunatley at the bottom of the page, the Macon law which prohibits tresspassing on these and other siights and the fines which will occur if you are caught tresspassing, and that chances are pretty darn good, you will be caught and turned in and that the city of Macon will accept your credit card payment and cash.

If this materializes, I'm sure it will be no problem for several of the local fans to crusie by every so often and refill the envelope box.

OK, I've had some requests to post some of the older photos to give an idea of what's been going on.

We'll start with some early ones that some of you might remember.

Now we'll get into some "Hello-Goodbyes"

And here's a couple of folks that obviously thought the gravesite was a drivethrough.

We end tonight with an scene that is seen all too often, the car with the single digit IQ

I'll get some more old ones for you, but right now I'm trying to work while the server is up.

Who ARE those people? Does anyone recognize who they are? Surely the one waving her hands like elephant ears at the camera isn't Kirsten West is it? Holy cow..please tell me it's not. The disrespect shown to Candace and those gravesites in those photos are apalling. And this is what goes on all the time!!!!

I don't know. I've seen Kirk a couple of times, but only recognized him from descriptions.

I just double checked......I was told it's Kirsten West who is on the wrong side of the rope mocking Candace and that subsequent photos that haven't been posted show the two of the other three people in the one posted on the other side of the rope with her.

I've been told for a long time that there are certain people who believe they have a right to cross the ropes any time they want to and have a sense of ownership of the graves that surpasses that of the family. I guess now those stories have been confirmed with irrefutable evidence......and it is apparant where many of the problems Candace and Buford have been having begin.

You'd think people who are making money off of the graves would show a little more respect....guess not.

ps. If you recognize the woman as being someone other than Kirsten West, please let us know who it is. I don't want to lay blame at the foot of the wrong person.

What a sad sequence of event's. It is nice to know that there is a plan in place to do what is so obviously nessasary... to build a fence.
Now, to formulate a plan to pay for it.
Straight cash donations to this specific fund right off the bat should cut a small percentage off that.
Raffles, Sale's and Auction of Merchandise which are donated is another way to raise money.
We have had our Zebo, Kim and my ebay donation, and we have had Ann's cookbooks. We ALL here take credit for both these endevours being a success, and we can still do more!
I would have no problem hosting any Item someone want's to donate to the cause.

We can set up a raffle, or a private auction for down the road. Too late for the Beacon, or Wanee this time around, but maybe by next year. Take our time, do it right, and we can set something up that could put the fund in a very good position for a while.
Kim, Zebo, and myself are in the middle of another project which should raise some substantial cash which we are planning to make a major contribution from. Kim has already discussed the details with Candace, we have her blessings..(waiting, and hoping for Galadriel's) and I will unveil the plan's down the road. I can't right now.
Um,... this ain't no shirt, trust me. Be prepared. I'm like a little kid at Christmas with this, but it has to wait.
We can make it Happen!

That's the one.....look right at home there don't they! Kudos to the one who stayed on the right side of the ropes!

Wonder how people who like to impress their frieinds by taking them to stand on the graves will take the news of a fence. Just listen to the outcry and the name calling. Only thing...this time the people who really do care for and respect the memories of Duane and Berry are getting behind the project.

It's sad how "entitled to" we as Americans feel about many things. Isn't that one of the things Europeons love & adore about us?
