We had to promise we wouldn't do that any more......at least not as a fundraiser....and that order comes all the way down from the supreme court!! (good things those men are appointed for life or they'd never have survived the scandal!)

Let's just stick to what we know is legal! :-)

I thought I'd give a perspective over the past few years on how the site has changed, and the progress of the plantings.


First, I'm waiting on an OK from dublindave to use a photo he took in 1973 of the gravesite (it's in the Places Gallery). In that photo there's nothing but bare ground around the graves.

I think it looks a lot better now.

I received a PM with a request for me to chime in here. I apologize for being late in doing so; I don't come to the Whipping Post often, and I hadn't checked my PMs in a while.

In light of some of the points that have been raised, I'll offer the following information for whatever it's worth. From the Official Code of Georgia Annotated:

16-7-23. Criminal damage to property in the second degree.
(a) A person commits the offense of criminal damage to property in the second degree when he:
(1) Intentionally damages any property of another person without his consent and the damage thereto exceeds $500.00;
(2) Recklessly or intentionally, by means of fire or explosive, damages property of another person; or
(3) With intent to damage, starts a fire on the land of another without his consent.
(b) A person convicted of the offense of criminal damage to property in the second degree shall be punished by imprisonment for not less than one nor more than five years.


16-8-12. Penalties for certain theft offenses.
(Excerpt)
(4) If the crime committed was a violation of Code Section 16-8-2 (i.e., theft by taking) and if the property which was the subject of the theft was a memorial to the dead or any ornamentation, flower, tree, or shrub placed on, adjacent to, or within any enclosure of a memorial to the dead, by imprisonment for not less than one nor more than three years. Nothing in this paragraph shall be construed as to cause action taken by a cemetery, cemetery owner, lessee, trustee, church, religious or fraternal organization, corporation, civic organization, or club legitimately attempting to clean, maintain, care for, upgrade, or beautify a grave, gravesite, tomb, monument, gravestone, or other structure or thing placed or designed for a memorial of the dead to be a criminal act;


17-4-60. Grounds for arrest by private person.
A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.

17-4-61. Taking of persons arrested before judicial officer or to peace officer.
(a) A private person who makes an arrest pursuant to Code Section 17-4-60 shall, without any unnecessary delay, take the person arrested before a judicial officer, as provided in Code Section 17-4-62, or deliver the person and all effects removed from him to a peace officer of this state.
(b) A peace officer who takes custody of a person arrested by a private person shall immediately proceed in accordance with Code Section 17-4-62.
(c) A peace officer who in good faith and within the scope of his authority takes custody of a person arrested by a private person pursuant to this Code section shall not be liable at law for false arrest or false imprisonment arising out of the arrest.

17-4-62. Taking of persons arrested before judicial officer within 48 hours.
In every case of an arrest without a warrant, the person arresting shall, without delay, convey the offender before the most convenient judicial officer authorized to receive an affidavit and issue a warrant as provided for in Code Section 17-4-40. No such imprisonment shall be legal beyond a reasonable time allowed for this purpose; and any person who is not brought before such judicial officer within 48 hours of arrest shall be released.

Thank you for the information. The first section seems applicable.....it costs about $500 to clean the marble on the gravesites.....that would make it a criminal charge to do rubbings, scratch your name into or leave things on the marble that cause discoloration. A question that pertains to the private person arrest....does that section constitute a felony?

The second section is also valuable as Candace and Buford can't even keep pebbles in the urns...people take the pebbles and anything else they can stick in their pocket. It would be a shame to be arrested for a pebble, but nice to know there are options. Back to the private person arrests....does that section constitute felony charges?

There appears to be substantial law that would make what's going on a criminal charge....I am wondering though, if a citizen's arrest would be doable.

And if you don't mind....what constitutes 'tresspass' and what are the penalties....and would this be subject for citizen's arrest?
