question is: 4 people own "the allman brothers band" right? gregg, butch, jaimo and dickey. dickey was fired, right? did the other 3 buy him out? did he sign over his part? what happens in a situation like that? do they have to pay him royalties? do he have to pay them royalties? who gets to do what songs? not that it's none of my business, i'm just curious how this stuff works.

The ABB was a six man partnership, reduced to four when Duane and Berry died. The way partnerships work legally is that a majority of the partners can remove a partner if they choose (depending ont he agreement it might have to be unanimous and I think that's the case with the ABB) The removed partner would have to be fairly compensated for past contributions to the partnership upon removal. I am not sure what was done here. Dickey owns the copyrights to his own songs so I'm certain he continues to receive payments from ASCAP and royalties for record sales. Probably he continues to have rights to compensation for the albums on which his songs are to be found. The bottom line is he has lost the right to use the name, the right to market himself using the name, the right to royalties from merchandise and other uses of the ABB logo etc. I am pretty well certain that once Dickey understood the situation his lawyer worked out a decent financial deal with the other three. As far as the songs go, anyone can play anyone elses songs at a live concert. For live albums, if Dickey's songs appear, they would need his permission and probably have to pay him. Were there any Dickey songs on "One Way Out"? I don't know how they work out the Instant Live thing now that they are doing numerous Dickey songs. Perhaps in the first years after Dickey left, he refused to let them record his songs but now he has relented. It would be interesting to know.

Of course those who know the ABB history know that Dickey orchestrated the firing of Jaimoe around 1980 (not sure of the exact year) and he was replaced by Frankie Toler. Jaimoe was back in 1990 but it looks like what went around came around.

Dickey is the president of the ABB, or at least he was last year. But what that means as far as his compensation I don't have a clue?

I would think that the ABB is a corporation, and the four remaining originals are the major shareholders. Some shares of the corporation were possibly given to other key players in the organization, possibly Kirk, Derek, Warren or Oteil, to give them an ownership position. Then the people that work for the corporation(musicians, road crew, bus drivers, guitar techs, etc) would be paid a salary or wage for services rendered.

Dickey owns a share of the ABB, but does not work for the ABB

thanx for all the answers. like i said, it's none of my business, i am just curious. something like this gives me a new appreciation for my own lawyer, who i have had for the last 25 years! it's a shame things like this happen, but it's like doug said, what goes around comes around. thank you all for the info.

I have heard this once before but never got any details........anyone care to fill me in as to the reasons involved? I want to say it was a financial dispute, but I can't really remember what I heard.

From what I remember about this was that Jamioe had severe back problems around that time that prevented him from touring hence the change. Anyone out there care to clarify ?

Im sure you are right, check the enlightend rouges
liner notes and you can see that jamoe
had very bad back problems at that time.
I dont think the band or dickey did anything
to jamoe but help him at that time.

Jaimoe was fired because he was questioning the bands finances, per demand of his wife at the time. Dickey had a lawsuit against Capricorn Records at the same time if memory serves me correctly and Jaimoe asking too many questions was in the way of the pending lawsuit. Had nothing to do with his back problems.

"Back Problems" was the reson given to the public. I think Tangerine is right about the money thing though.

It's like this "Creative Differences" sounds a lot better than "We don't want to work with him unless he makes some major changes"

Kind of off the subject but related, Can anyone explain the riff between Steve Kimock & Phil Lesh? I understand they are at odds & would just like to know why. Thanks.

I think it is your business. It is all our business because we are fans and we are interested in these issues. They are not salacious but are legitimate things to be interested in. "Midnight Riders" has a lot of discussion about the business arrangement of the band and that arrangement had a lot to do with the original breakdown and break up of the band as well as the falling out with Phil Walden and Capricorn.

You are correct. Jaimoe's back problems had nothing to do with him leaving the ABB in 1980. in 1979, the band toured with a backup drummer in case Jaimoe coulsn't go on. It is water under the bridge. Obviously Jaimoe and Dickey made up or Jaimoe would not have returned in 1989. But it is good to keep the facts straight.

depends on who you talk to for the reasonings behind this one....but most of them end up as Steve having a conflict with Jill about something or other.

I never really liked Kimock that much, but I lost all respect for him when he split in the middle of a tour...plenty of bands don't like eachother for whatever reason and still manage to play together...but Kimock decided to take his toys and go home.

Granted, this led to the Derek/Warren/Jorma circle...which was awesome...but still.
