Marine's dad ordered to pay protesters' court fees

BALTIMORE - The father of a Marine killed in Iraq and whose funeral was picketed by anti-gay protesters from Kansas was ordered to pay the protesters' appeal costs, his lawyers said Monday.

On Friday, Court of Appeals for the Fourth Circuit ordered Snyder to pay $16,510 to Fred Phelps. Phelps is the leader of Topeka's Westboro Baptist Church, which conducted protests at Marine Lance Cpl. Matthew Snyder's funeral in 2006.

The two-page decision supplied by attorneys for Albert Snyder of York, Pa., offered no details on how the court came to its decision.

Attorneys also said Snyder is struggling to come up with fees associated with filing a brief with the U.S. Supreme Court.

The decision adds "insult to injury," said Sean Summers, one of Snyder's lawyers.

The high court agreed to consider whether the protesters' message is protected by the First Amendment or limited by the competing privacy and religious rights of the mourners.

Checking to see if the charitable foundation which my father co-founded, and for which I do some work can help this family under their mandate. If not, I have already lined up some fellow Iraq and Afghanistan vets who are willing to help. I am on a daily email list of former Marines with whom I am friends, and the response to this has already been great as they have actually dealth with these morons personally…..a few responses already (my favorite response is from one of my buddies at the end):

If the MCLEF doesn't support, I'm willing to make a contribution. Might be more effective if we contribute as a group.

Jim let us know if MC-LEF does anything, if not I am willing to kick in.


To everyones point, one of our buddies (some salty gunney) that we campaigned with actually knocked one of these guys out at a funeral in AZ. The cops that were there claimed they saw nothing.

Church members are seeking to recoup costs from federal appeals court, which dismissed Snyder's lawsuit against them. Snyder's lawyer, Sean Summers, said the court declared last week that Snyder was responsible for the costs.

Efforts to reach an official from Westboro Baptist Church were unsuccessful Monday.

Such mandated reimbursements are common after appellate court cases, Summers said.

When the U.S. Supreme Court hears Snyder's case in the fall, its decision will ultimately make a big difference as to whether or not Snyder can eventually recoup that money, Summers said.

"It's rubbing salt in an open wound," Summers said.

The Topeka, Kansas-based Westboro Baptist Church, led by Rev. Fred Phelps, preaches an anti-homosexual message. Members maintain that combat deaths in Iraq and Afghanistan are God's retribution for America's tolerance of gay men and lesbian women.

Church members have promoted that agenda with a series of intentionally provocative demonstrations outside funerals of servicemen and women who were killed in combat, during which they chant and hold signs bearing messages such as "Thank God For Dead Soldiers."

Church members staged such a protest outside the funeral for Snyder's son, Marine Lance Cpl. Matthew Snyder, in Westminster, Md. Snyder's son was killed in Iraq in 2006 when his Humvee overturned.

Snyder sued the protesters, and a Baltimore jury awarded him $5 million in damages for invasion of privacy and emotional distress. But the 4th U.S. Circuit Court of Appeals overturned that decision on First Amendment grounds in September 2009.

Earlier this month, the U.S. Supreme Court agreed to hear the case.

Philadelphia lawyer Howard Bashman, an expert in appellate law, said that the loser in appellate court cases typically compensate the winner for court costs. Those costs tend to be higher when the plaintiffs win, because they must supply a complete copy of the original court case.

The winners may decide not to go after that compensation, frequently because the legal costs involved in pursing the funds would be more than the money they could recoup, Bashman said.

FUNDING THE FUNDLocal lawyer Sean Summers said the federal appellate court rejected arguments that Albert Snyder should not be assessed $16,500 in legal fees because he doesn't have the means to pay them.

The privacy and religious rights are pretty nebulous compared to first amendment rights. As the anti-abortionists point out, there is nothing about privacy in the Constitution. As I recall, Phelps clan was protesting in the public right of way, so as digusting and misguided as his protest is, the first amendment protects them.

This is one of those cases that reminds me of the old axiom, "hard cases make bad law." To have true free speech, we have to take the bad w/ the good.

As the article points out, it's part of the law that the prevailing party in Federal court is entitled to its fees. The court would have been reversed if it had done otherwise. I do not see the Supreme Court appeal going anywhere.

I was just gathering the subscription cards right now.

Oh, and I sent the article to my cousin who was career Navy and who stays in touch with a lot of the military organizations. I've asked him to make sure everyone reads that article. I figure there will be some kind of response from that in a few days, knowing Garry.

Excellent video...thank you. Here is what I got back from my cousin:

This is definitely wrong. We have Fort Lewis here in Washington, it’s the home of the Stryker Brigade. Many of those troops have been killed and the protesters have been at their funerals. The “Sons of the American Legion” have a motorcycle club at most of their Posts, now when there is a military funeral they surround the service to prevent this from happening. They do not use violence, just their presence seem to keep peace at the service.

P.S. I passed it on, have already had responses back from my old military buddies.
