I have to chirp up about Law & Order: Criminal Intent again. Tonight's episode was very good, revolving around a Steven Hawking - type physics genius in a motorized wheelchair, only this one could talk. Not the chair, like KITT!--the physicist!

Sang, half the time I still watch X Files reruns on Sundays at 11 p.m. I don't know about watching tonight, since I've seen it a couple times already--they're in the middle of that series of shows where Mulder is on a train with the E.T.-dissecting Japanese doctors.

Agreeing with Peter, D'Onofrio is a GREAT actor. Criminal intent is the best Law & Order in my book. Don't watch it as much as I'd like 'cause it conflicts with The Wire, and The Sopranos. Also loved Deadwood. Good job by HBO on all 3 shows. Same to CBS for Raymond,King of Queens and Charlie Sheens show (name escapes me). Star Trek 'Enterprise' is good because, well, it's STAR TREK!! Finally I must confess I not only watch, but enjoy 7th Heaven.Maybe because I come from a dysfunctional family or maybe because it's pretty damn funny sometimes.Oh, and I watch a wee bit of sports too...

... and I've watched some ER this year, really good too. Maura Tierney is an awesome actress. I loved her on Newsradio but as a dramatic actress she's taken it to a new level. Adding Parminder Nagra should help the show too, she was great in 'Bend it like Beckham'. I like what I've seen so far this year, nice to see the show back on the upswing (IMO)

I don't watch much TV, although I've gotten into the series "24" recently. I've seen Seasons 1&2, Season 3 isn't on DVD and the shows future is up in limbo. I've jinxed Kiefer!

I just checked Amazon.com....the complete 3rd season of "24" will be available December 7th.

Libby, just yesterday I noticed that Fox is now running commercials for 24's new season, starting in January!
24 is a top-shelf show.

My fav NEW show is Lost. I'm still hanging on to law and Order and Law and Order/SVU. ER still gets a look every week. Original CSI is a must watch each week and my guilty pleasure is, Joan of Arcadia

I'm also looking forward to the new 24. I still watch the Simpsons all the time, but the funniest show on TV right now might be Arrested Development. If we're just counting episodic TV (and throwing out sports), the only other show I always make sure to catch is Futurama, sadly only in reruns. I'm hoping to get some DVDs of it soon.

Here's an interesting true-life story connected with Law & Order (the regular one, not my L&O: Criminal Intent):

New Trial for a Mother Who Drowned 5 Children
By ADAM LIPTAK
Published: January 7, 2005

Andrea Yates, the Texas woman convicted of drowning her children in a bathtub, was granted a new trial by an appeals court in Houston yesterday. The court ruled that a prosecution expert's false testimony about the television program Law & Order required a retrial. . . .

Yesterday's ruling was narrow and novel. It turned on testimony by Dr. Park Dietz, a psychiatrist who was the prosecution's sole mental health expert. Dr. Dietz testified that Ms. Yates was psychotic at the time of the murders but knew right from wrong. The latter conclusion meant that she was not insane under Texas' unusually narrow definition of legal insanity.

On cross-examination, Dr. Dietz was asked about his work as a consultant on Law & Order, a program Ms. Yates, the appeals court said, "was known to watch." He was asked whether any of the episodes he had worked on concerned "postpartum depression or women's mental health."

"As a matter of fact," he answered, "there was a show of a woman with postpartum depression who drowned her children in the bathtub and was found insane, and it was aired shortly before the crime occurred."

That statement was false: There was no such episode. The falsehood was discovered after the jury convicted Ms. Yates. . . .

"The state used Dr. Dietz's false testimony to suggest to the jury that appellant patterned her actions after that Law & Order episode," the decision said. "We conclude that there is a reasonable likelihood that Dr. Dietz's false testimony could have affected the judgment of the jury."

Dr. Dietz did not explain the supposed significance of the Law & Order episode at the trial. But prosecutors returned to the subject in a separate cross-examination and in closing arguments, suggesting that she had copied the program in a way that implied lucid planning and premeditation.

Dr. Lucy Puryear, a psychiatric expert for the defense, was questioned about the nonexistent episode. In an interview yesterday, Dr. Puryear said the questions to her conveyed a powerful impression to jurors.

"Had she seen that show and gotten ideas from it," she said, "it would say that she had the ability to think in an abstract way and come up with a plan. That would mean she could tell the difference between right and wrong." . . .

"It wasn't material," Mr. Owmby {one of the prosecutors} said, meaning that Dr. Dietz's testimony about Law & Order was not a significant factor in the jury's decisions. "It didn't affect her fair and just trial rights at the trial level." . . .

Deborah W. Denno, a law professor at Fordham University who has studied and written extensively about the Yates case, was critical of other aspects of Dr. Dietz's testimony, too. He testified, for instance, that Ms. Yates's delusions that her thoughts were coming from Satan indicated that she must have known they were wrong.

"He interpreted everything she did as evidence of premeditation and intention," Professor Denno said. "He is a hired gun in the worst sense."

In an interview with the New York Times a month after Ms. Yates was convicted, Dr. Dietz said he had found the case troubling.

"It would have been the easier course of action," he said of his own testimony, "to distort the law a little, ignore the evidence a little and pretend that she didn't know what she did was wrong."

Wharfy, that was a great start, wasn't it?! I'd be laughing with edgy glee when they went into commercial, like "Oo-hoo-hoo, this is tense!"

Libby, please finish your Season 3 before 8 p.m. EST (7 normal time) tonight so you can watch! Of course there are new faces this season, but if you had watched the first two episodes last night, it would not have ruined anything at the end of Season 3 for you. And tonight is two more episodes, so you don't want to get too far behind--1/6 of the day (7-11 a.m.) already after tonight.
